Web Site Design/Web Development

1. Costs:The prices on the sample sites are for guidance only. Prices may fluctuate due to changes in exchange rates, though every effort is made to ensure that all published prices are correct. E&OE.
   
2. Payment: Payment is accepted by Secure Credit or Debit Card, UK Cheque or UK Postal Order.
   
   • Credit and Debit Card payments are taken via a third party secure payment processing company called PayPal.
     
   • A deposit of 50% is required before commencement of any Website or Banner design. This is will pay for the costs of any research or development that may already have taken place. Final Balance is due after confirmation of acceptance but before the site is uploaded to public Webspace.
     
   • Domain registration fees are to be paid in full, in advance as these must be immediately paid to the approriate authority.
     
   • Site Hosting fees must be paid in full, in advance. This is to cover the administration costs of setting up Webspace.
     
   • Maintenance fees, where applicable, are due from the date of uploading the site to your Webspace and are payable monthly, in advance.

3. Sample Sites: All the sample sites shown are GENUINE sites. Please be aware when browsing them that should you place an order on one of these sites you WILL be commited to a contract with the site owner.
   
4. Proofs: All designs will be uploaded to a private server and the client will be given a URL, Username and Password to access them. The client will have access to freely browse the design and email any comments for a period of 48 hours from the time that password is sent.
   
5. Copyright: Copyright of the site design shall remain with the client on acceptance. The copyright of any photographic, graphic or textual material used must be owned by the client. If copyright of any such material is later found to be owned by anyone other than the client, then said client will be advised and the item(s) removed from all design work.
   
6. Liability: If the work is deemed defective for any reason, the publisher's liabilty (if any) shall be limited to rectifying such defect.
   
7. Data Protection: Any information that we gather is covered by the Data Protection Act 1998. Client details WILL NOT be made available to third parties for any reason and all details are only held for the purposes of contract between BBG Design Limited and the client.

These terms and conditions may, from time to time, be changed or updated.

Web Site Hosting

1. Spam/Unsolicited Mass E-mail: BBG Design Limited does not tolerate the sending of spam. We will suspend or terminate an account for which the owner is believed to be sending out unsolicited mass mailings. Mailing Lists may be operated as long as individuals choose to subscribe to receive mailings, if a complaint is received that this is not being carried out BBG Design Limited reserves the right to suspend or terminate your account without notice.
   
2. Billing: Customers that pay by credit card or debit card will be charged automatically each month, it is the customers responsibility to ensure that they have sufficient credit to cover the payments.
   
3. Backups: Full backups are made by BBG Design Limited, no guarantee's are made of any kind as to the integrity of these backups. If loss of data occurs due to an error of BBG Design Limited, we will attempt to restore data at no charge to the customer. If loss of data occurs by an action of the client BBG Design Limited will attempt to restore data at a £40 fee to the customer which will be payable in advance.
   
4. Chat Rooms: We do not allow customers to install their own chat rooms on our servers as they tend to use large amounts of system resources. We have provided a Chat Room scripts wich can be used and customised as required. We do not allow IRC or IRC Bots to be run on BBG Design servers.
   
5. IP Numbers: BBG Design maintains control of all I.P. numbers and addresses that may be assigned to the client and reserves the right to change or remove any and all IP numbers and addresses.
   
6. Pornography: Pornography of any kind, or links to such material is not permitted on BBG Design's Limited's servers. If any such content is found BBG Design Limited reserves the right to immediately cancel the account
   
7. Server Resources: All accounts are monitored for server abuse, if an account is using more than 5% of system resource, running any process that requires more than 5Mb of memory space or uses more than 15 CPU seconds the account may be suspended without notice.
   
   It is unacceptable to:
   (a) Make use of a script to point an additional domain, other than the one assigned to your account when you signed up, if you require to do this, sign up for a package that includes pointed domains
   (b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
   (c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
   (d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
   (e) Run any process which interacts with the MySQL Database Management Server using persistent connections. The use of persistent connections to connect to the MySQL Database Management Server on BBG Design Limited servers is strictly prohibited. Any account found to be in violation of this policy will be immediately suspended.
8. Illegal Use: BBG Design Limited's servers may be used for lawful purposes only. Unlawful uses of our services include
   • Hacking
     
   • Warez
     
   • Distribution of copyrighted material (e.g. MP3's, Mpegs, Roms)
     
   • Copyright Infringement
     
     
   BBG Design Limited reserves the right to report illegal activities for prosecution.
   
   Violations of system security is prohibited, examples include: messages sent on an intrusive basis to any network, Accessing data not intended for user. Probing the security of a network. Spawning dozens of processes. Port scans, ping floods, packet spoofing, Denial of Service attacks, sniffers, flooding, spoofing, ping bombing, winnuke. Promulgation of viruses. The presence of such programs on an account, whether or not run, will result in suspension or termination of your account.
   
9. Traffic: A domain which exceeds the traffic allowance included in the account will be charged at a rate of £5 per GB, if more than 10,000 MB transfer is required this can be arranged by logging a support request via the Support Desk.
   
10. Customer Responsibility: The client is responsible for all material located on the account, and securing the username/password used access the account.
    
11. Limitation of Liability: BBG Design Limited is not responsible for any claimed damages, which may result from BBG Design Limited's servers going offline, or being unavailable for any reason. Including damages which may result from the corruption or deletion of data.
    
    BBG Design will be the sole arbiter as to what constitutes a violation of these Terms of Service. BBG Design Limited reserves the right to remove any account without prior notice. The failure by a customer to meet or follow any of the above Terms of Service is grounds for account suspension or deactivation. We reserve the right to refuse/cancel service at our sole discretion.
    
12. Modification: BBG Design Limited reserves the right to add, delete, or modify its Terms of Service at any time without notice.
